Orders and contract formation

After receiving your order, we will normally send an order confirmation acknowledging receipt of your order.

We reserve the right to reject or cancel an order where, for example:

• There is an obvious pricing or product-description error.

• We reasonably suspect fraudulent or unlawful activity.

• We are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.

A contract for the supply of goods will be formed in accordance with the order and confirmation process used on our website.

Prices and payment

All prices are displayed in pounds sterling (GBP) and include VAT where applicable.

Delivery charges are shown separately before you complete your purchase.

We use third-party payment providers to process payments. We do not generally have access to your full payment card details.

We take reasonable care to ensure that prices displayed on the website are accurate. If we discover an obvious pricing error, we may contact you before fulfilling the order.

Delivery

We currently deliver to addresses within the United Kingdom.

Delivery information, estimated times and circumstances including supplier-direct fulfilment are set out in our Delivery Policy.

Unless otherwise agreed, goods should normally be delivered without undue delay and within 30 days of the contract being made.

If delivery by a particular date was essential and you made this clear to us before placing the order, you may have additional rights if we fail to deliver by that date.

Returns, cancellations and refunds

Nothing in these terms limits your statutory rights relating to faulty, damaged, misdescribed or otherwise non-conforming goods.

Faulty or incorrect goods

If goods are faulty, damaged, not as described or the wrong goods have been supplied, please contact us at info@properparty.store.

Depending on the circumstances, you may have rights to a repair, replacement, price reduction or refund under the Consumer Rights Act 2015.

Personalised and print-to-order products

Some products may be printed or produced after you place an order.

Print-to-order production does not automatically remove your statutory cancellation rights.

However, genuinely personalised or custom-made products may be exempt from the statutory right to cancel where they have been made to your specifications or are clearly personalised.

Any such exemption will be stated in the relevant product information where applicable.

Promotions and discount codes

Where we offer promotional codes or discounts, additional terms may apply.

Unless expressly stated otherwise:

• Promotional codes cannot be exchanged for cash.

• Only one promotional code may be used per order.

• Promotional codes may be subject to expiry dates or other restrictions.

• We reserve the right to withdraw or amend a promotion where reasonably necessary.

Promotions will not affect your statutory rights.

Intellectual property

The Proper Party name, logo, website design, text, graphics and other original content on this website are owned by us or our licensors.

You may not reproduce, copy, distribute or commercially exploit our content without our written permission, except where permitted by law.

Product names and references to artists, films, brands, franchises or eras are used to describe products or themes. Unless expressly stated, Proper Party is not affiliated with, endorsed by or sponsored by any third party referred to on the website.

Website availability

We aim to keep the website available and functioning properly, but we do not guarantee that it will always be available, uninterrupted or free from errors.

We may temporarily suspend or modify the website for maintenance, security, updates or other operational reasons.

Limitation of liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

Subject to the above, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses arising from matters outside our reasonable control.

Nothing in these terms affects your statutory rights as a consumer.

Events outside our reasonable control

We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including serious disruption to courier networks, supplier failures, natural disasters, fire, flood, industrial disputes, government restrictions, widespread technical failures or other events outside our reasonable control.

Where such an event affects your order, we will take reasonable steps to keep you informed and minimise the impact.
